SC seeks ATS response on Bombay blast suspect's plea

NEW DELHI: The Supreme Court on Tuesday sought response from the Union home ministry, Delhi Police and Maharashtra's ATS on the petition of Taqi Ahmad, brother of arrested accused Naquee, seeking a CBI probe into the 13/7 Mumbai serial blasts case.
A bench of justices Altamas Kabir and J Chelameshwar also stayed Taqi's arrest but asked him to report to the Jamianagar police every alternate day and posted the matter for hearing to February 22. The petitioner had sought a CBI probe complaining that the ATS and Delhi Police had been subjecting him and his family members to harassment by charging them with false cases. Taqi, who has also been summoned for questioning by the ATS, has pleaded that SC transfer the blasts probe to CBI.
The petitioner has sought probe against officials of ATS and Delhi Police's Special Cell who "implicated" him. According to the petition, "The Special Cell persuaded Naqi to act as its informer to which he agreed. He was taken to Mumbai to identify the 13/7 suspects. On Jan 9, Naqi aid his work was done and he would return to Delhi. Then we wereinformed that the ATS had arrested Naqi in a forgery case and was later shown as the key accused in the 13/7 blasts," it said.

New Delhi The differences between the Maharashtra Anti-Terrorism Squad and the Delhi Police over arrests in the 13/7 Mumbai attacks again came to the fore today. Two ATS officials were taken by the Delhi Police to a police station after they landed up in Jamia Nagar of the capital for serving summons on the brother of an alleged suspect without reportedly keeping local authorities in the loop.
Mohammad Taqi Ahmed’s brother Naqi was arrested last month by the Maharashtra ATS on terror charges. The Delhi Police doubts this theory, saying Naqi was their informer and had been helping them track top Indian Mujahideen activist Yasin Bhatkal alias Shahrukh. The Delhi Police also believes Naqi unknowingly helped Bhatkal get a house on rent in Mumbai.
“They (the ATS) have been threatening my other brother in Mumbai and saying that if I do not join their investigations, they will arrest him also. I fear for my life. My brother (Naqi) was only helping the police, he was in no way involved in the Mumbai blasts,” Taqi told The Indian Express at the Jamia Nagar police station today, saying that terrified of the ATS, he called up the police saying he was being forcibly taken away.
A crowd gathered around the house as the news of the ATS team’s visit spread. The local police reached the house and took the ATS officials along with them to the police station.
Additional Director General of Police (Maharashtra ATS) Rakesh Maria, however, denied that any such incident had taken place. In an SMS response, Maria told Express that reports of his men being detained by the Delhi Police were “not true”.
Taqi said he had received a letter from the ATS on January 17 asking him to join the investigations. “I did not go citing health reasons. This time they came and said that since I did not respond to the earlier summons, they were serving me a notice under Section 160 CrPc, which requires me to join the investigations.”
“If they wanted to summon him for questioning they should have come to us first,” said a senior Delhi Police officer. However, Additional Commissioner of Police (Southeast) Ajay Chowdhury said: “The Maharashtra Police had come to serve the notice and they left after it was received by the concerned person. A constable escorted them to the house.”
In his complaint to the police, Taqi alleged a threat from the ATS. “Ever since the illegal detention and false implication of Naqi, I have been consistently raising my voice against it...this has irked the Maharashtra ATS... I fear I would be implicated falsely by them.” (Vijaita Singh reported in IE)
