SC hits on corrupt practice, quashes 122 licences of 2G; PC spared

NEW DELHI: Supreme Court has put its seal on corruption charges hounding former Union Minister A. Raja for using corrupts practices in allocations of licenses for 2G spectrum by quashing all 122 licences issued by him. This has also shocked corporate sector which is used to get favors with the bruit power of money. Certainly to-days judgment of SC will put a break on biggest source of corruption in the corridors of power. The apex Court has left it on trial court to decide upon the alleged role of P. Chidambaram, then Union Finance Minister.
The court passed the order on petition filed by Janata Party Chief Subramanian Swamy's to make home minister Chidambaram a co-accused in the 2G spectrum allotment case. The apex court said that the trial court should decide the matter within two weeks. Special CBI Judge O P Saini, who is hearing a separate petition of Swamy to prosecute Chidambaram, has already reserved his order for February 4.
Two judge bench of SC also directed that Central Bureau of Investigation (CBI) would submit its report on the 2G scam probe to the Central Vigilance Commission (CVC).
Janata Party President Subramanian Swamy's has filed a petition seeking CBI probe into the alleged role of Mr. Chidambaram in the spectrum scam, and on two pleas by lawyer Prashant Bhushan seeking cancellation of 2G licences and setting up of an SIT to monitor probe into the scam.
Swamy has has alleged that Chidambaram did not deliberately used his authority to stop jailed former telecom minister A Raja from giving away spectrum at throwaway prices to select companies.
Only on Tuesday the bench comprising Justices Singhvi and Justice Ganguly had passed an order which upheld right of a citizen to seek the prosecution of Raja for the 2G scam and indicted the PMO for delaying prosecution of the sacked telecom minister.
Licences held by five companies including the local joint ventures of Norway's Telenor and Abu Dhabi's Etisalat were cancelled in the verdict, calling into question the stability of business contracts and regulation in India.
The Court ruled that the current licences will remain in place for four months, in which time the government should decide fresh norms for issuing licences, a lawyer involved in the case said.
India's image as an investment destination was dented over the past year as the economy slowed, government reforms stalled and the telecoms scandals along with other high profile graft cases heightened concerns about government policies.
Disposing of the petitions filed by Subramainan Swamy seeking a direction to the CBI to probe the alleged role of Chidambaram, a bench comprising justices G S Singhvi and A K Ganguly said that its order should no way influence the proceedings before the trial court.
The apex court said that the trial court should decide the matter within two weeks. (Agnecies)
