MP Catholic organisation challenges RTE

Bhopal : Accusing the government of interfering in the affairs of minority institutions, the Catholic Bishops Conference of Madhya Pradesh has challenged the implementation of the Right to Education Act in the state.
A division bench of the Madhya Pradesh High Court on Wednesday issued notices to the Principle Secretary (school education), the Directorate of Public Instructions and the District Education Officer in Bhopal. Advocate Jamesh Anthony, who appeared for the Conference, argued that educational institutions run by the minorities enjoyed constitutional privileges.
Challenging the gazette notification issued by the MP government to implement the legislation, the petitioner alleged that the schools were being made to admit students against their wishes. The government was interfering in their administrative matters and also wanted to fix the fee structure, the petitioner alleged calling the notification unconstitutional.
The institutions were worried about the possibility of falling quality because students to be admitted under the new legislation were being selected by a lottery system, said petitioner Anand Muttungal, who is also spokesman of the Catholic Church.
The division bench headed by Chief Justice Rafat Alam has given the respondents two weeks to file their replies.
The court order came in response to a writ petition filed by Catholic Council of Bishops of Madhya Pradesh through its spokesperson Father Anand Muttungal.
The state government order, petition said, undermined the rights guaranteed to the minority institutions and allowing government officials to begin to meddle in with the administration of the minority schools. They also issued illegal orders for admission with direction for compliance report and also interfered with the day to day administration in schools.
Petitioner contended that this interference was not only the violation of the constitutional safeguards to minority educational institutions guaranteed under Articles 29 and 30 but also affected quality education the institutions are providing.
The petition has also included direction issued by the Central government to state government reminding it that the RTE Act was made keeping in view of the constitutional safeguards guaranteed to the minorities.
Even after these clarifications from the Central government, the state government officials continued to use the RTE as a means to harass minority run education institution, he alleged in the petition.
Advocate James Antony appeared for the petitioner. The bench of Chief Justice Rafat Alam and Justice Alok Aradhe posted matter for next hearing after a month.
